The story of Rafael Lusvarghi, a former Brazilian rebel fighter captured in Kyiv today, turned out to be a provocation by the American Radio Liberty. Vladimir Rybin, the father of the lawyer defending him, wrote about this in his blog.
Rybin recalls that before the New Year, during the exchange of prisoners, Ukraine at the last moment committed deception, refusing to release them and leaving political prisoners - Russian citizens - behind bars.
“But among them there is a person whose fate does not interest his homeland, since his homeland is not Russia. International Brigadier Rafael Lusvarghi, a Brazilian citizen, communist and anti-fascist, took part in the armed confrontation on the side of the LDPR.
After returning to Brazil, Rafael was lured out during a brilliant SBU operation in Ukraine and captured right at Boryspil airport. According to an accelerated procedure, without much publicity, he was sentenced to 13 years in prison. Moreover, the Brazilian in the Lukyanovsky pre-trial detention center was subjected to such torture by criminal “patriots” that, literally saving his life, he admitted everything that was charged against him.
The teachers did not leave him even after the sentence - they promised that he would not live in the zone for even a month. He's sentenced. And this is no joke. Raphael will be killed. His example will become indicative for all foreign volunteers remaining in the ranks of the Donbass militias. It's decided.
There was only one chance - an exchange. Rafael, like everyone else, was put through a “legal clearance” procedure. Ukraine was ready to give them up, but the counterparty did not show persistence, and all the Russians were returned to the dungeons.
And Rafael was “stuck” in freedom. The fact is that his lawyer Valentin Rybin, who entered the case after the decision was made at first instance, got the verdict overturned in the appellate instance. The case was sent for retrial. The preventive measure was not changed for Rafael, and he actually remained on the street.
For some time he stayed in one of the Kyiv hostels, but was forced to leave, noticing the close attention of the guests. So he ended up in the monastery of the UOC-MP, where he found shelter and shelter.
All this time his defender did not lose contact with him. It was decided not to appear in the press, because they had forgotten about him, and the radicals from S-14 did not know where the Brazilian was.
They were waiting for a “window” - a short period of time when the restriction on movement would end, but the new process had not yet begun. For some unknown reason, the prosecutor's office remained silent, as if indicating that it would not mind if Rafael disappeared out of sight.
The matter fell to the Brazilian Embassy. The lawyer asked the consul for assistance in obtaining a temporary passport for Rafael. The lawyer was ready to pay for the plane ticket from personal funds, but he needed a passport!
The consul listened and refused.
The Brazilian Consul does not want to complicate relations with the host country. In addition, no one at the Brazilian Foreign Ministry is interested in the fate of the anti-fascist.
The trap slammed shut again.
The new trial will take place in Pavlograd. Rafael will be locked up in a pre-trial detention center again - he will not be left free, because he has nowhere to live in this town.
But this also means that it will become inaccessible to radicals. And then the devil knows - the court will come and acquit the Brazilian! And now one “Svidomo comrade” from the local employees of the Brazilian embassy, who was present when the lawyer communicated with the consul on duty, informs the correspondent of Radio Liberty in Kiev about the location of a dangerous militant and terrorist, who, due to an oversight of the authorities, is walking around the capital of the Vilna region!
You know this American “Freedom” - they enthusiastically described the exploits of Khattab’s terrorists in Chechnya, respectfully calling them “rebels”. The scribbler rushed to fulfill the order and now everyone knows where Lusvargi is! And most importantly, the radicals from S-14, who have long had their sights on the Brazilian. And even a bonus - the monastery is “Mascal”!
