The Darnitsky District Court of Kyiv will hold a regular hearing in the case of the editor-in-chief of the newspaper “Working Class” Alexander Bondarchuk, whom the SBU accuses of separatism for publishing an interview with Pavel Gubarev, one of the leaders of the pro-Russian rebellion in Donbass.

The court considered the defense's application to challenge the judge, who, according to the defense, shows bias and dependence on the current government, but refused to satisfy it.

“Today we considered the defense’s application to challenge Judge Rudyuk due to the fact that he allowed his activities to depend on the existing state power,” the defendant’s lawyer, Nikolai Myagkov, commented to a PolitNavigator correspondent on the outcome of the meeting. “However, the court refused, citing the fact that such grounds are not provided for in the criminal procedural legislation. But in paragraph 4 of part 1 of article 175, other circumstances that allow one to doubt the impartiality of the court are grounds for challenge. Therefore, we consider this decision to be erroneous. However, it is not subject to appeal, so we will raise this objection in a further appeal against the verdict if it does not suit us.”

“We believe that the court has consistently demonstrated bias in this case,” he added.

Communist Alexander Bondarchuk is accused under Article 110, paragraph 1. Criminal Code of Ukraine (“Intentional actions committed with the aim of changing the boundaries of the territory or state border of Ukraine in violation of the order established by the Constitution of Ukraine, as well as public calls or distribution of materials calling for the commission of such actions”). The reason for such accusations were several articles in the newspaper he edited.
