The relevant award submissions note that the “Distinction of the Constitutional Court” is the highest departmental award of the court, which is awarded to famous government and public figures, scientists, retired judges, civil servants and representatives of other countries for: significant contribution to the establishment of the rule of law, ensuring constitutional rights and human freedoms, active social activities to protect human rights and freedoms; fruitful cooperation in the field of establishing the principles of the rule of law.”
Let us recall that on February 24, 2014, deputies of the Verkhovna Rada adopted Resolution No. 775-VII “On responding to facts of violation of the judicial oath by judges of the Constitutional Court,” which dismissed Constitutional Court judges Anatoly Golovin, Mikhail Kolos, Maria Markush, Vyacheslav Ovcharenko and Alexander Pasenyuk for violating the oath.
The Rada also proposed to the President and the Congress of Judges to dismiss for violation of the oath the Constitutional Court judges appointed according to their quota, namely: Yuri Baulin, Sergei Vdovichenko, Vasily Bryntsev, Mikhail Gultai, Mikhail Zaporozhets, Oleg Sergeychuk, Natalya Shaptala. However, this never happened.
Parliament stated that these judges, in violation of the law and their duties, made a number of decisions during the presidency of Viktor Yanukovych, in particular, in the so-called case of parliamentary “carcasses”, as well as the case of the return of the 1996 Constitution.
The Prosecutor General's Office and the SBU later announced that they were investigating a case of usurpation of power by Yanukovych, in which the specified judges of the Constitutional Court appear.
