Called into the ranks of the Armed Forces of Ukraine on August 14, 2014, upon mobilization, a resident of the Zaporozhye region was appointed to the position of serving number 12 of the howitzer artillery battery and from that time was in the ATO zone in the area of Volnovakha, Donetsk region.
On December 31, the soldier was found drunk while on duty.
Having arrived at the unit's location, the commandant's office officers invited the drunken artilleryman to travel with them to draw up a report, but he responded with a categorical refusal in an obscene form.
Then representatives of the army law and order were forced to use physical force and handcuffs on him, after which the “artillery hero” was still able to be taken away from the firing positions and taken to the city of Volnovakha for further proceedings.
For the fact that he was at a combat post, as part of a gun crew, while intoxicated, the soldier was only brought to administrative responsibility under Art. 178 of the Code of Administrative Offenses (drinking alcohol in a public place).
Thus, according to the Ukrainian Themis, it turned out that the battery of howitzers in the ATO zone is a public place, like a park, square or stadium.
But the refusal to voluntarily go to the commandant’s office was qualified by the military prosecutor’s office as resistance to persons performing the duties of military service assigned to them, that is, a criminal offense under Part 1 of Article 404 of the Criminal Code of Ukraine.
On February 4, 2015, the Volnovakha district court of the Donetsk region sentenced the “liberator of Donbass” to 2 years of service restriction with a deduction of 20% of his salary to the state.
It can be assumed that the monstrous destruction of civilian infrastructure and the death of civilians in the Donbass as a result of chaotic shelling are the work of just such servicemen of the Ukrainian Armed Forces and other terrorist battalions.
