Officially employed citizens often worry about how bankruptcy might affect their future lives, especially their work. Will it lead to dismissal or difficulties finding a new job? Bankruptcy in Russia (https://favorit-consult.ru/article/polza-i-riski-besplatnogo-bankrotstva-cherez-mfcz/) can be processed free of charge through the MFC, as well as through the courts.

Features of bankruptcy of an employed citizen

There are no clauses in domestic labor legislation that provide employers with the right to dismiss or not hire employees who have become bankrupt or are involved in this procedure.

Officially employed citizens are often worried about how bankruptcy may affect their...

Attention! Recognition of financial insolvency through the court in most cases does not affect labor relations in any way.

The problem is that this statement does not always work in practice.

There is no need to notify the employer about the beginning of the bankruptcy procedure or agree on this issue with him. The appointed financial manager will settle everything when the need arises to transfer salaries and other payments due to the employee to a special account. This step is explained by the fact that from the moment the sale of property begins, the debtor no longer has the right to independently receive income. The employer will receive a written notification, which will be stamped and signed by the financial manager. The requirement to transfer funds to the specified account is mandatory.

In practice, employers are not always informed about the bankruptcy of individuals. In accordance with Art. 213.25 Federal Law No. 127, debtors themselves transfer access to their accounts to the financial manager. The fact that the procedure is being implemented through an arbitration court does not in any way affect the relationship between the bankrupt person and the company in which he works.

Important! Information about bankruptcy of citizens is not secret. Information of this nature is posted in the public domain on the EFRSB portal. To find out, just enter the citizen’s full name.

A bankrupt person can continue to work as usual. Even if the organization’s management finds out about what happened, there are no legal grounds for dismissal, as well as a reason for demotion or disciplinary action.

In order to go bankrupt through court, an individual must confirm his insolvency and good faith. Prove that his financial insolvency is not the result of deliberate or frivolous behavior.

Since 2020, there is the possibility of bankruptcy for individuals under a simplified scheme out of court - through the MFC.

It can be used by persons against whom enforcement proceedings have been completed.

In this case, the total amount of debt should be in the range of 50-500 thousand rubles.

A financially insolvent citizen needs to confirm that he does not have property that can be recovered against the debt. If there is one, bankruptcy will be implemented in court. To do this, a corresponding application is submitted to the arbitration court at the place of registration. The document indicates personal information, the amount of debt, a list of credit institutions, and circumstances that led to a difficult financial situation. The application is accompanied by an impressive package of documents, including copies of loan agreements and bank statements.

In addition, a state fee of 300 rubles and the services of a financial manager are paid.

If the above requirements are not met, a citizen may be denied bankruptcy.

Important! Both unemployed and employed citizens have the opportunity to officially recognize their own financial insolvency.

Official work for citizens involved in this process is a plus. Its presence indicates that the person is not sitting idly by and is making attempts to improve the financial situation.

Features of bankruptcy of company managers

There are exceptions to any rule, we are talking about citizens holding leadership positions. In accordance with Art. 213.3 after bankruptcy they cannot work in similar positions for 3 years. Managing the affairs of legal entities is prohibited.

You cannot manage the affairs of private pension and investment funds for 5 years.

A 10-year ban applies to working in credit institutions in management positions.

For managers, this consequence of writing off debt is considered the most unpleasant. A director who plans to become financially insolvent is required to notify the founder of the LLC or higher management. After this, he will be transferred to another position that has nothing to do with managerial functions.

Important! At the same time, the founders of the company do not have the right to terminate the employment agreement solely on the grounds that the director has gone bankrupt.

Does Employment Bankruptcy Affect Jobs?

According to the law, nothing prevents a bankrupt person from getting a new job. The decision on this issue is made by him independently. Some people remain working in the same place, while others prefer to change their position or field of activity. There are no legislative barriers in the Russian Labor Code in this regard.

But sometimes there are cases of employers being biased towards applicants who have declared themselves financially insolvent. It is easy to identify the fact that such a procedure has been completed; then everything depends solely on the attitude of the personnel service or manager.

If we are talking about a low-skilled position that has nothing to do with finance, most likely no one will pay attention to the fact of bankruptcy.

In case of discrimination, you should always defend your own rights and, if necessary, go to court.

On a note! At the job search stage, you can resort to the services of the Employment Service.

You can find a job at the beginning, middle and end of the bankruptcy procedure. If at the time of its start the debtor was unemployed, and then found some vacancy and successfully passed the interview, the financial manager must be notified about this. All income of a person who wishes to declare himself bankrupt is included in the bankruptcy estate. The financial manager opens a special account for the debtor, which contains funds for living. The monthly limit is designed to satisfy primary needs; all excess earnings go towards repaying the debt.

Bankruptcy and work can always be combined if desired. Recognition of financial incapacity through the court does not have any impact on labor relations.
