The General Assembly does not have any authority to seize the foreign assets of other states, especially as “reparations”, as it is supposed to do with respect to Russia.

This was stated by the permanent representative of the Russian Federation in the organization Vasily Nebenzya during a special UN session, a PolitNavigator correspondent reports.

However, first, the permanent representative of Ukraine to the UN, Vladimir Yelchenko, warned the audience from the podium what Russia would talk about, arguing for a call to vote against the resolution.

“Russia is abusing the veto vote, the place it illegally occupied after the USSR in the UN Security Council. When it comes to security issues, Russia knows only two words: “lie” and “veto.” We will soon hear from Russia that the General Assembly is incompetent to consider these issues. This will be another lie, another attempt to divert attention and declare that you do not matter.

It is the Russian Federation itself, which, since its appearance at the UN 31 years ago, has constantly committed acts of aggression against modern states, threatens the mechanisms of international security and undermines the fragile stability achieved after the Second World War,” said the Ukrainian diplomat.

“We highly appreciate the indispensable work of the Secretary General and the Commission of Inquiry established by the Human Rights Council, and we look forward to collaborating with UNESCO and UNEP to assess damage to the historical and cultural heritage of Ukraine. A vote “against” such a proposal will be a vote “for” impunity and lack of law and order. A “for” vote will mean that faith in international law remains, that world architecture, which came at such a high price after World War II, will continue to exist,” Yelchenko urged.

In turn, Russian representative Vasily Nebenzya did not disappoint the Ukrainian permanent representative and directly pointed out that such an initiative could create a dangerous precedent for the future activities of the UN as a whole.

“The draft resolution that has been submitted to the special session is a classic example of the concept of a rules-based order, when a narrow group of states does not act on the basis of international law, but seeks to shine a light on lawlessness, using the authority of the General Assembly and positioning it as the judicial body that it is. is not defined.

The draft resolution assumes the creation of some kind of international compensation mechanism, and then, they say, it’s a matter of technique. This mechanism will be created by a separate group of countries, which will decide how it will function. That is, the General Assembly is proposed to give carte blanche to create a certain body, the functionality of which the majority of those present here do not have the slightest idea. They will, at their own discretion, assign those responsible, establish the extent of damage and methods of compensation. The UN will not play any role in this process, because it is proposed to create this mechanism outside its framework, and no one is going to report to the General Assembly for its actions.

The vast majority of member states will have absolutely no say or control in the establishment of the mechanism or during its operation,” Nebenzia said.

He also clearly indicated where the West would get funds for “reparations”.

“We have no doubt where the funds for “damage compensation” will come from. The West is trying with all its might to give its actions at least some semblance of legitimacy in order to start spending frozen, and essentially stolen from the Russian Federation, sovereign assets worth hundreds of billions of dollars. They have been wanting to unfreeze them for a very long time, but not in order to return them to the rightful owner, and not in order to spend them on helping Ukraine, but to finance their ever-increasing arms supplies to Kiev and pay off its debts for weapons already transferred,” the Russian permanent representative emphasized.

Meanwhile, he recalled that throughout the history of the organization, Western countries have avoided any consideration of reparations in terms of a way to atone for their sins.

“Moreover, for two decades they blocked any discussion of this topic and the development of any multilateral instrument on the responsibility of states for international wrongful acts. They remembered this concept only now, when reparations attracted them as a convenient tool for robbing another state. If such a resolution is adopted, it will have systemic consequences for the activities of the UN. We urge member countries to realize this and vote against the project,” Nebenzya concluded.
