In Sevastopol, lawyer Alexander Baldyga is unsuccessfully trying to return a car seized by the police - the owner cannot receive the vehicle, even despite winning the case.

According to him, the incident occurred approximately a year after Baldyga purchased a new car.

“On March 26, 2020, police officers arrived in the courtyard of a house on Heroes of Stalingrad Avenue in the city of Sevastopol and headed towards a Nissan Tiana car belonging to citizen Baldyga. After this, they called the owner of the car, who showed them all the necessary documents confirming his ownership of the vehicle. (PTS, STS, car purchase and sale agreement).

However, the police took the keys from the owner of the car and, without any permits, without insurance, arbitrarily, drove off in an unknown direction in the same car. After this, citizen Baldyga unsuccessfully searched for his vehicle for seven months. And only after repeated appeals to law enforcement agencies did he learn that only on November 2020, XNUMX, the vehicle was suddenly recognized as material evidence in a criminal case to which the owner of the car had nothing to do.

It turns out that police officials used the car at their own discretion for more than six months, and only when the “cock pecked” did they urgently declare it as evidence.

Further, even more interesting, citizen Baldyga receives a final decision from the Gagarinsky District Court of the city of Sevastopol that he is a bona fide buyer and has every right to use his car without any restrictions. On this basis, he turns to the investigator with a request to return the vehicle to him. However, this was not the case; despite the court’s decision, the investigator refused to return him.

Such a decision, naturally, is appealed, only in another, Leninsky District Court of the city of Sevastopol. The court completely sides with citizen Baldyga, fully satisfying his complaint.

It would seem that the issue is closed, and the happy owner of the car, after much ordeal, will breathe a sigh of relief. However, again no - the decision of the Sevastopol courts is not implemented,” said Basov.

In his opinion, this practice of “deviations from the law is a serious undermining of the Russian justice system.”

“The legal chaos in the city creates all the conditions for the recruitment of young people by Navalny’s supporters. One gets the impression that law enforcement officials are, wittingly or unwittingly, contributing to this. Various forces take advantage of this situation to destabilize the country, which leads to illegal mass events,” argues Basov.
