Sevastopol, March 22 (Navigator, Alexander Puras) - The Leninsky District Court of Sevastopol put an end to a criminal case that was almost ten years ago, acquitting the accused - a rather rare occurrence for the hero city, where such verdicts are handed down only a few times a year.

In December 2004, the corpse of a woman with obvious signs of violent death was discovered in the courtyard of a household in the center of Sevastopol. The police officers, in hot pursuit, detained the suspect in this crime - the husband of the deceased (!), who was there at the time the police officers arrived.

Inspired by such success, employees of the Leninsky regional department, together with representatives of the district prosecutor's office, did not pay due attention to the collection of evidence, the proper preparation of protocols and the packaging of material evidence.

Having spent more than 10 hours in the Leninsky District Department of Internal Affairs, the suspect wrote a confession in which he confessed to the murder of his wife. Probably due to the fact that he sincerely repented of what he had done, the suspect described what happened in a confession, using specialized legal terms and figures of speech, having a secondary education “behind him.” At the same time, he developed a chest bruise and needed to see a doctor. It is also worth noting that after this he continued to confess in legal terms.

As soon as the victim of police brutality managed to leave the district department, he stated that he gave confessions as a result of physical pressure from the police. The investigation did not like this turn of the case, and the police began to fabricate evidence. For example, a protocol for reproducing the situation and circumstances of the event was drawn up by the investigator right in the office, and when questioned at the court hearing, the investigator could not explain who signed the protocol instead of the suspect. It is also worth noting that the case materials do not contain the lion’s share of photographs and video material filmed during the investigative actions.

In addition, illiterately seized evidence and their improper procedural registration subsequently led to uncertain results of expert research, which was also given a legal assessment at the court hearing.

It is also worth noting that numerous checks by the prosecutor’s office into the fact of illegal use of violence against the detainee by employees of the Leninsky Regional Department of the Ministry of Internal Affairs of Ukraine in Sevastopol did not produce any results. According to prosecutors, there is no event or corpus delicti in the actions of the police.

Despite all the tricks and attempts of the investigation to falsify evidence, the court came to the conclusion that the examined materials of the criminal case and the testimony of witnesses in their totality do not prove the guilt of the defendant in committing a crime under Art. 115, part 1 of the Criminal Code of Ukraine (intentional murder).

The husband of the murdered woman was found not guilty by the court of the charges brought against him and acquitted for lack of proof of his participation in the crime. The criminal case was sent to the prosecutor's office to conduct a pre-trial investigation and identify the person who committed the crime.
