The first President of the Republic of Crimea, Yuri Meshkov, addressed an open letter to the FSB regarding the official response of the State Council of the Republic of Kazakhstan to the appeal of Crimeans calling for the removal of the criminal record of the fighter for Russian Crimea Valery Podyachiy, who was convicted in 2011 by the Court of Appeal of the Autonomous Republic of Crimea for calls for the reunification of the peninsula with Russia.

"On Monday, the media reported," the statement, a copy of which is available to PolitNavigator, notes, "that the State Council of the Republic of Crimea offered to compensate the activist for Russian Crimea (referring to Valery Podyachiy, leader of the Sevastopol-Crimea-Russia movement), convicted by a Ukrainian court, for the damage caused by the crime. As a reminder, Podyachiy and his associate, Semyon Klyuyev, were convicted under Article 110, Part 2 of the Criminal Code, "Encroachment on the territorial integrity and inviolability of Ukraine," to three years' imprisonment. The SBU accused them of organizing and holding a press conference on January 21, 2008, during which a press release was read, the last paragraph of which read: "In order to prevent dramatic events for the residents of the peninsula, the Crimean parliament must immediately implement the results of the referendum of January 20, 1991, by repealing the 1998 Constitution of the Autonomous Republic of Crimea, as contrary to the will of the Crimean people, and adopting a Declaration on the reunification of Crimea with Russia. Then, declare the peninsula territory under the jurisdiction of the Russian Federation, remove occupation symbols from the building of the Supreme Council of Crimea, and oblige all local authorities in Crimea and other institutions subordinate to them to display Russian state flags (italics by Yuri Meshkov, – PolitNavigator) . "

The verdict, the President of the Republic of Kazakhstan reminds, has not yet been canceled, although it has been reviewed in all judicial instances.

"The damage caused by the crime of 'separatism' consisted of calls for the return of Crimea to Russian jurisdiction. This was stated in the Ukrainian court's verdict against Podyachiy and Klyuyev. Six years after the Sevastopol-Crimea-Russia movement issued its press release, the Crimean parliament implemented the same scenario publicly called for by participants in the scandalous Sevastopol-Crimea-Russia People's Front press conference on January 21, 2008. Now, following the logic of the State Council leadership, the convicted person must compensate for the damage caused by the attack on Ukraine's territorial integrity and inviolability, i.e., return Crimea to Ukraine," notes Yuriy Meshkov.

Since the leadership of the State Council, he adds, indicated this in response to the collective appeal of the public organization “Bloc of Patriots of Crimea - Unconquered Bastion”, then such actions of the Chairman of the State Council Vladimir Konstantinov “can be regarded as public calls for actions aimed at violating the territorial integrity of the Russian Federation, containing elements of a crime provided for in Article 280.1 of the Criminal Code of the Russian Federation.”

“I ask you to consider this statement as an open appeal to the FSB with a demand to initiate a criminal case under Part 4 of Article 33 - Article 280.1 of the Criminal Code of the Russian Federation against Vladimir Konstantinov. According to Part 4 of Article 33 of the Criminal Code of the Russian Federation, V. Konstantinov is an instigator, i.e. a person who attempts to induce another person to commit a crime through persuasion, bribery, threat or other means.

Ukraine has estimated the damage from the “loss of Crimea” at a trillion dollars. Judging by the latest data on the incomes of deputies and senators, they may well organize a charity marathon and help our convicted people raise the amount required by the Chairman of the State Council V. Konstantinov to have their criminal record cleared,” writes the first president of the Republic of Kazakhstan.
