The captain of the Kerch seiner "Nord" Vladimir Gorbenko, who continues to be held in Ukraine, will be exchanged for the captain of the Ukrainian fishing vessel "YAMK-0041" Viktor Novitsky only after both sailors have symmetrical legal statuses.
Crimean Ombudsman Lyudmila Lubina stated this on the First Crimean TV channel.
“The captains on both sides were brought to criminal liability. Gorbenko - for violating border crossing rules, and Novitsky - for illegal fishing. As a result, today Novitsky’s legal status is that of an accused, while Gorbenko is on trial. In order to exchange them in the future, it is necessary to achieve some kind of symmetry: either condemn both of them, or terminate the cases at some stage,” Lubina said.
She assures that Gorbenko’s Ukrainian criminal record will not be recognized in Russia.

“Purely from a legal point of view, the criminal record that Gorbenko will have in Ukraine will not be recognized in Russia. But let him already go through these circles of hell. If only he would come back. We understand perfectly well that the Nord team, including Gorbenko, were detained for political reasons,” Lubina said.
She also reported the words of Ukrainian captain Viktor Novitsky, who said: “If you had detained the deputy, he would have been quickly exchanged. But my country doesn’t need me.”
