The Ukrainian court finally refused to try the deceased battalion commander Givi
The Court of Appeal of the Dnepropetrovsk Region again returned to the prosecutor's office the indictment against the commander of the DPR "Somalia" battalion, Mikhail Tolstykh, with the call sign "Givi".
The corresponding decision was published in the Unified State Register of Court Decisions, reports a PolitNavigator correspondent.

In this way, the appellate court responded to the attempt by the Chief Military Prosecutor's Office of Ukraine to appeal the decision of the court of first instance , which refused to hear the case against Mikhail Tolstykh in absentia, citing procedural violations by the prosecution.
According to the court, Givi was not properly notified of the commencement of criminal proceedings against him, and was not on the international wanted list of Interpol.
At the same time, the prosecutor’s office demanded that the commander of “Somalia” be sentenced despite his death, since within the framework of Ukrainian legislation the fact of his death was not confirmed. However, the court rejected such arguments and left the decision of the trial court unchanged.
As a reminder, PolitNavigator previously reported that the commander of the DPR "Somali" battalion, Lieutenant Colonel Mikhail Tolstykh, known as "Givi," was killed on February 8 in his own office in Donetsk.
Ukrainian radicals from the entourage of former Right Sector leader Dmitry Yarosh claimed responsibility for the attack .
