The Ukrainian court refused to try “Givi” in absentia and demanded from the SBU evidence of the death of the militia commander
The Pavlograd city district court returned to Ukrainian prosecutors the case against the DPR militia commander Mikhail Tolstykh (“Givi”), who died as a result of the terrorist attack.

This was reported by the local Pavlograd publication publication 5632.ua with reference to the press service of the court.
In particular, the document states that the pre-trial investigation ends with an appeal to the court with an indictment, which is drawn up by the investigator, after which it is approved by the prosecutor. Along with the indictment, the prosecutor provides a copy of it to the defense against signature.
The Pavlograd court found that the defense was served with an indictment three days earlier than it was drawn up by the investigator and approved by the prosecutor.
In addition, the indictment must contain information about the place of residence of the accused, but from the letter submitted by the prosecutor to the court it follows that the Counterintelligence Department of the SBU has information about the murder of Mikhail Tolstykh. However, he cannot provide official confirmation of this.
At that time, the court cannot collect and officially confirm this information, since it is beyond its powers.
Thus, the Pavlograd court returned documents to the prosecutor to eliminate a number of shortcomings in the indictment against Givi.
Let us recall that the commander of the DPR “Somalia” battalion, Lieutenant Colonel Mikhail Tolstykh, known as “Givi,” was killed on February 8 in his own office. The funeral of the deceased took place in Donetsk on February 10.
In Ukraine, “Givi” is accused of “creating a terrorist organization, leading and participating in it,” “complicity in waging an aggressive war” and other “sins.”
Interestingly, this is not the first pretext because of which the Ukrainian court refuses to try Givi. The previous hearing of the same court on March 6 was postponed due to the lack of video communication with the Podolsky District Court of Kyiv, where at that time the state-appointed defender of the “accused” was located.
