The so-called “anti-oligarchic” law, adopted today in the second reading by the Verkhovna Rada (bill No. 5599 “On the prevention of threats to national security associated with the excessive influence of persons with significant economic or political weight in public life (oligarchs)”), does not contain mechanisms for real legal liability of oligarchs.

Director of the Ukrainian Institute of Policy Analysis and Management Ruslan Bortnik stated this in a comment to a PolitNavigator correspondent.

“The adoption of the “anti-oligarchic” law will lead to increased control by the Office of the President over financial flows and the work of large media outlets. Everyone who is supported and financed by large Ukrainian businesses today finds themselves under more serious, significant pressure.

But not a single oligarch will suffer. This law does not contain a mechanism for returning the property of the oligarchs, their assets into state ownership, and there is no mechanism for any legal liability of the oligarchs. But it creates conditions under which the oligarchs will be more accommodating in their relations with the authorities.

After all, the authorities can simply put a “black mark” on them. As a result, the oligarchs will lose access to credit funds, it will be difficult for them to work with banks, they will become a victim of law enforcement agencies, suffer reputational losses, and become simply toxic.

And in order to avoid reputational losses, many oligarchs will simply go to negotiate with the National Security and Defense Council and the President’s Office,” concluded Ruslan Bortnik.
