During the inspection, it was established that the construction is being carried out by the service cooperative “Housing and construction cooperative “Streletsky proezd, 14” in the absence of permits. A multi-apartment residential 5-storey building was erected without permission in an area of individual residential development, where the construction of private households no higher than 3 floors for one family is allowed.
Based on this fact, the Gagarinsky District Prosecutor's Office opened an administrative case against the developer under Part 1 of Art. 9.5 of the Code of Administrative Offenses – construction, reconstruction of capital construction projects without a construction permit.
The case materials were sent to the State Construction Supervision and Expertise Inspectorate of Sevastopol for consideration and decision-making. The sanction of this article against a legal entity provides for a fine in the amount of 500 thousand to 1 million rubles.
According to the requirements of current legislation, the commissioning of a building built without permits is not allowed. At the same time, the Inspectorate has the authority to file a claim in court to recognize the construction as unauthorized and to dismantle it.
