Chaly could not overcome Menyailo’s veto on taxes in Sevastopol, but remained unconvinced

The head of the deputy corps, Chaly, explained this by the current circumstances, but said that he remained unconvinced.
The dispute over one of the most acute and fundamental laws between the government of Sevastopol and the Legislative Assembly ended in favor of the government. Deputies unanimously supported the law on tax rates for FEZ residents in the version of the city governor Sergei Menyailo. The veto he imposed on the implementation of the law on the zero rate adopted earlier by the Legislative Assembly was ultimately unable to be overcome. At the same time, the author of the law in the version of the Legislative Assembly, Vyacheslav Aksenov, having changed his point of view, could not convincingly explain to his colleague, deputy Yuri Kruglov, what the difference is in the fourth paragraph of the law.
“How does establishing a profit rate of 2% create tax discipline for a taxpayer if establishing a zero tax rate does not exempt the taxpayer from submitting reports to the tax authority and does not exempt him from the control of fiscal authorities? If this is the case, then the original 0 or 2% debate we had in December makes absolutely no sense. Am I right or wrong? Please clarify,” Deputy Kruglov addressed Aksenov.
It is worth noting that one of the key arguments the governor cited was the possibility of more effective control over the activities of a resident with a tax rate of 2%.
“The governor wrote everything correctly. Establishing a minimum justified rate of 2% creates tax discipline for the taxpayer, and establishing a zero rate does not exempt the taxpayer from reporting and from the control of fiscal authorities, i.e. this is all true. But there is still a difference between zero and two percent. The most important thing is that in both cases the taxpayer reports. In both cases, he may be held accountable for a late report or for an unreliable report,” Aksenov explained as best he could. At the same time, it was felt that he was not entirely comfortable speaking, until Alexey Chaly, who had previously pushed the law through the Legislative Assembly with appeals and propaganda, spoke out.
Chaly himself gave much more clear explanations. Thus, according to him, “the law itself is structured in such a way that it applies to both residents and non-residents of the FEZ,” and therefore non-residents suffer, while there are no residents yet. At the same time, he admitted with reservations that Sevastopol and Crimea represent a single subject of the Russian Federation, which means that the general rate has reasonable grounds, however, he added that “as you know, it was not by chance that a separate subject was created, since we There are technological and other features.”
“There is a point of view according to which we should be unified with Crimea, there is such a position of the Ministry of Finance. Honestly, I don’t agree with this motivation, I already told you about this last time,” Chaly emphasized.
“Therefore, I believe that, indeed, it is wrong to have differences in tax rates globally for all types of activities. In this regard, I would support the position of the Ministry of Finance, but it seems to me that it would be correct if there could be other rates for priority areas of activity for each region, which would actually indicate certain priorities. However, in this case, of the two proposed options in the situation in which we find ourselves, there is no option that would provide this. Therefore, my proposal, taking into account the relationship with innocent non-residents of the SEZ, is to accept the government’s proposal as amended by the governor. However, I declare that I remain in my position and will prepare proposals for amending this law as it relates to priority residents, who are special specifically for the strategic development of Sevastopol,” said the head of the Legislative Assembly.
However, Sergei Menyailo, commenting on his opponent, made it clear that after all, this was a compromise decision and concessions had to be made, including him.
“The starting position that the government proposed is correct, and then as we work. I agree with Alexey Mikhailovich that yes, different subjects of the Russian Federation have different basis for the direction of their activities. Somewhere there is industrial production, somewhere tourism, somewhere maritime activities, etc. Of course, there is no need to unify this. But the initial conditions for starting activities must be the same, as prescribed in the law for the Crimean Federal District,” Menyailo said.
At the same time, he admitted that the 2% rate could be floating.
“The bottom line is not even two or zero percent. If we say that it is zero percent and we say that the resident may be dishonest, then we will not be able to increase the interest rate. If we are talking about two percent, then Vyacheslav Viktorovich will not let us lie that in the process of working with a resident we can reduce the interest rate for one or another area of activity that we deem necessary. Therefore, today, precisely today, we do not have the right to create conditions different from the entire Federal District,” the governor concluded.
