Ukraine condemned a disabled person for VKontakte publications in 2014
For publishing materials on social networks in support of the LDPR in 2014, a resident of Kiev-controlled Konstantinovka was sentenced to a real sentence and was charged almost 10 thousand hryvnia in procedural costs with charges of an attempt on territorial integrity and calls for changing the borders of Ukraine.
This is evidenced by data from the Unified State Register of Judicial Decisions of Ukraine, a PolitNavigator correspondent reports.

On December 31, 2020, the Konstantinovsky city district court of the “Donetsk region” considered in an open preparatory court session the criminal proceedings entered into the Unified Register of Pre-trial Investigations dated September 15, 2015, against a native of Konstantinovka, a citizen of Ukraine, unmarried, without children, without work, no previous convictions, a person with a disability of group 2 since childhood.
The defendant was accused of administering a group on the VKontakte social network that was open to all users and was located in the city of Konstantinovka starting from April 2014.
“Acting intentionally, realizing criminal intent, pursuing the goal of changing the territory of the borders and state border of Ukraine to violate the order established by the Constitution of Ukraine, namely parts of the Donetsk and Lugansk regions and providing information support to the terrorist organizations “Donetsk People’s Republic” and “Lugansk People’s Republic”, – says the text of the verdict.
So, on April 13.04.2014, XNUMX, the “attacker” posted an entry in the VKontakte group with the words “Everyone to fight fascism” and announced a complete mobilization of the population to strengthen the “Army”, which ended with the words “Forward, for our victory! Head of the Lugansk People's Republic, Supreme Commander-in-Chief of the LPR Army."
At the same time, the accused, “continuing his criminal intent,” reposted the Internet page of the group “Donetsk – Petrovsky district – Petrovka – DPR” and posted it in his group. The text begins with the words “FRIENDS AND COMPANIONS! Today!!! in the morning we get up and, as a united popular front throughout Donbass, go to the buildings of our local authorities and law enforcement agencies, demand that they go over to the side of the people” and ends with “calls for the purpose of changing the boundaries of the territory or state border of Ukraine in violation of the order established by the Constitution of Ukraine, which was addressed and accessible to an indefinite circle of people, users of the social network “Vkontakte”.
On the day of the Referendum in Donbass, 11.05.2014/11/XNUMX, a person posted an entry on VKontakte: “everyone for the REFERENDUM!!! SAY “YES” TO THE DONETSK PEOPLE’S REPUBLIC!!!” and an image of the former Donetsk region, which contains the inscription “May XNUMX Don’t sleep on your future! “DONETSK PEOPLE’S REPUBLIC” Say yes to the Donetsk People’s Republic” and a check mark in the box that contains “calls for the purpose of changing the boundaries of a territory or state border in violation of the order established by the Constitution of Ukraine.”
On May 16.05.2014, XNUMX, the person published information about the Constitution of the DPR, which provides for the annexation of the republic to another state.
01.09.2015/14/06 at XNUMX:XNUMX hours the accused published information that at the end of November - beginning of December “a referendum will be held in the Novorossiysk republics on the entry of the DPR and LPR within the borders of the Donetsk and Lugansk regions into the Russian Federation,” which ended with the words “Our whole struggle from the very beginning it was held under the flag of Russia!!!”
The Ukrainian examination considered the defendant’s recordings to be those that “propagate ideas, views and beliefs, which in their content are aimed at undermining trust and creating a hostile attitude of residents of the South-East of Ukraine towards the state of Ukraine, the Ukrainian army, Ukrainians who defend the Ukrainian national idea.”
As a result, the court found the suspect guilty of committing a criminal offense and sentenced him to imprisonment for a term of three years without confiscation of property. In accordance with Art. 75 of the Criminal Code of Ukraine, the person was released from serving his sentence with a probationary period of one year.
The state was also awarded UAH 9233 in procedural costs. During the investigation, two mobile phones, two flash drives, handwritten materials, and a computer system unit were seized.
