Lawyer: The moratorium on construction in Sevastopol violates the Constitution of the Russian Federation

Sevastopol, July 25 (Navigator, Olga Nikolaeva) – The ban on construction in Sevastopol violates the constitutional right of developers to economic activity; they can legally appeal their legitimate interests.

The lawyer of the Sevastopol law firm, Alexander Molokhov, stated this on the air of the STV program “Essentially”.

Let us remind you that by government order dated July 15, construction work on sites in the coastal zones of the city was suspended until the end of the holiday season. The resolution is in effect “to ensure the safety of recreational conditions and create favorable conditions for the holiday season.”

“I believe that this resolution violates the Constitution of the Russian Federation - Article 55 of the Constitution is violated, which states that any restrictions on constitutional rights and freedoms, and the right to freedom of economic activity, Art. 34 - guaranteed by the Constitution - they are possible only on the basis of Federal Law. And not on the basis of some resolution, regulatory by-law of a subject of the federation,” says Molokhov.

According to him, “the situation has turned out to be peak,” the developers were not warned in advance, they are forced to curtail their activities and “suffer losses.”

“Such a total ban affecting the entire construction business is not very correct, and what is called “with sabers drawn,” without taking into account all the specifics, creates an obstacle to normal economic activity,” the lawyer added.

He believes that restrictions on rights and freedoms and economic activities are permissible if we are talking about protecting the foundations of the constitutional system, protecting the health of citizens, morality, safety, and well-being of the population.

“If any of the entrepreneurs find the strength to appeal this decision in court, then they will have every chance of success,” said Alexander Molokhov, advising entrepreneurs to unite.
