Moscow - Simferopol, April 21 (Navigator, Mikhail Stamm) - Re-registration of real estate in Crimea should be completed before 2017, Kommersant reports. Only Crimean and Sevastopol real estate registered after January 1, 2013 are subject to automatic inclusion in the Unified State Register of Rights (USRE). Rights to objects previously registered by the Ukrainian BTI and land committees are also recognized; they will be processed in a simplified manner.

The Ministry of Economy has prepared amendments to the legislation on cadastral registration and registration of rights to real estate in Crimea and Sevastopol. The bill distinguishes two categories of objects - registered before January 1, 2013 and after. The division was caused by the fact that it was at that moment that a unified register of property rights to real estate was introduced in Ukraine - before this date, there was no centralized registration of real estate.

The agency proposes to recognize the legal significance of rights to such real estate and register them in a declarative manner (this is proposed by Russian legislation on simplified registration of rights to real estate). In particular, the specifics of Crimea will be taken into account, and the peculiarities of registering rights to land plots and individual housing construction projects will be taken into account.

Objects registered since January 1, 2013 were taken into account in the unified register of rights, which was maintained electronically in Kyiv, and now access to it by Russian authorities is closed.

According to the head of the real estate department of the Ministry of Economy of the Russian Federation, Andrei Ivakin, there should be no problem with restoring the lost part of the property: “All documents on the basis of which entries were made in this register of rights are stored in local departments and partly with notaries. During the period from January 1, 2013, a small part of all real estate was registered.”

For this category of objects, the procedure is clearly defined: documents that are the basis for registering real estate must be translated into Russian. At the same time, it is stated that notarization of the translation and the signature of the official who carried out the translation is not required.

Paper documents must be converted into electronic form and certified with an enhanced qualified electronic signature of an official.

After completion of all procedures, copyright holders must be issued certificates of state registration of rights of the Russian Federation.

Inclusion in the Unified State Register, as well as the issuance of certificates or extracts from it, will be free.

Entering information into the state cadastre should take no more than 30 days.

The cadastral value of the object will be equal to its standard value before Crimea entered the Russian Federation.
