Sberbank’s refusal to recognize DPR documents contradicts Putin’s decrees and the position of the Russian Foreign Ministry - Russian director
By refusing to issue money to the depositor's representative under a power of attorney executed in the DPR, Sberbank violates not only the decree of the President of the Russian Federation, but also the recommendations of the Russian Ministry of Foreign Affairs, as well as the Convention on Legal Assistance and Legal Relations, concluded in Minsk on January 22.01.1993, XNUMX, to which they are parties Russian Federation and Ukraine.
This is stated in a letter from Russian director Alexander Korobko, addressed to the President of the Management Board of Sberbank PJSC, Herman Gref, reports a PolitNavigator correspondent.
Korobko notes that due to the coronavirus pandemic and border closures, he has been unsuccessfully trying for over a month to retrieve his money, which is stored in a safe deposit box at a Sberbank branch in Moscow.
“Despite my repeated calls over the course of a month (to my “personal manager”, to your support service on the Sberbank Premier line, to your Chairman of the Board and to the “Customer Care Service”), I still cannot gain access to your funds stored in a safe deposit box in the above-mentioned branch of your bank...
The bank’s refusal (in extreme conditions, against the backdrop of a pandemic) to meet me halfway causes serious financial and moral damage to me personally and to my media company, and continues to put me in a difficult position. I consider your decision to not recognize the power of attorney executed in the DPR not only unfriendly and inhumane, especially taking into account its vocabulary, but also legally incorrect.
In the letter of the President of the Federal Notary Chamber A.K. In this regard, I ask you to accept a power of attorney for my authorized representative in Moscow to have access to my safe deposit box and the savings put aside in it “for a rainy day,” the director asked.
In his letter, Korobko appeals to the recommendation of the Russian Ministry of Foreign Affairs, which back in 2007 wrote to the Federal Notary Chamber that non-recognition of part of the territories cannot be a reason for refusing to accept documents issued there: “To your request regarding the possibility of accepting Russian notaries to perform notarial acts of documents emanating from state entities not recognized by the Russian Federation as independent subjects of international law, we inform you as follows.
The Russian Foreign Ministry proceeds from the fact that international law does not prohibit states from recognizing the validity of certain legal acts of bodies exercising actual power in territories not controlled by official authorities.”
According to one of the leaders of the public movement “Donetsk Republic” Alexey Muratov, this letter from the Ministry of Foreign Affairs is extremely important for the population of the DPR: “This alone serves as the basis for the recognition of powers of attorney of the DPR!”
As a reminder, well-known Russian journalist Andrei Karaulov previously stated that Sberbank was setting a dangerous precedent by refusing to issue funds to depositors with a power of attorney issued by DPR notaries.
Korobko also reported that Rossiya Bank helped him solve the financial problem and continue filming the movie "Alpha R" in Donetsk.
