As Navigator learned, the reason for Bulyga’s return was the petition of several deputies of the State Council of the Republic, with which they addressed Aksenov. Having put his signature on the petition, acting. the head and at the same time the Prime Minister of Crimea legalized the decision of the Feodosia City Court, which rehabilitated the ex-mayor with its decision of March 14.

At the same time, the court applied the norms of decriminalization of criminal articles to Bulyga by analogy with Yulia Tymoshenko. However, the law removed the level of responsibility under Art. 364 and 365, while Bulyga was convicted under Art. 367 for official negligence. However, the inconsistency of the articles did not prevent the Feodosia City Court from applying decriminalization standards to the ex-mayor of Koktebel, releasing him and restoring him with all rights.

On this basis, Bulyga demanded that the seat of mayor of Koktebel be returned to him, since he was removed from office by the council on January 30 in connection with the entry into force of the court verdict.

According to Navigator sources, an active lobbyist for the return of the ex-mayor of Koktebel, against whom the Crimean prosecutor’s office opened 5 criminal proceedings and only one brought to trial, was the deputy of the Crimean City Council, Evgeny Mikhailov, who controls the local recreation center “Priboy”. The construction of sewerage treatment facilities (STP), which Koktebel had been waiting for for 24 years, started during Bulyga’s absence, created significant competition for Priboi, which had a monopoly on the reception of liquid household waste in Koktebel. With the commissioning of Globus LLC, the declared capacity of 2,5 thousand cubic meters of wastewater, the economy controlled by Mikhailov will be forced to reduce the cost of connecting to the sewerage system, which is not included in the plans of the deputy, who has now received the powers of a link between the Council of Ministers and the State Council of Crimea.

Mikhailov made the first attempt to return Bulyga to the post of mayor of Koktebel on his own, appearing at a session of the council with persuasion to vote for the restoration of the ex-head to his post. Local deputies greeted this proposal with bewilderment, since by order of the Prime Minister a moratorium was imposed on personnel decisions. In addition, by a resolution of the Parliament of Crimea, all decisions made by the courts under Ukrainian legislation after February 21 on the territory of the Republic lost their legal force.

After this, Mikhailov wrote a petition addressed to Aksenov and collected the signatures of deputies interested in the return of Bulyga, since during his reign he took on many obligations to allocate land plots in the Koktebel Valley even beyond the boundaries of his powers, receiving financial compensation in advance for the troubles.

At the same time, Bulyga’s lobbyists are not embarrassed by the existence of an agreement with Globus LLC on the commissioning of treatment facilities in the most problematic resort areas of Crimea - Malorechensky, Ordzhonikidze and Sudak. If the commissioning of the Koktebel WWTP is disrupted, the investor has no guarantees to continue working in Crimea and the fecal resorts will greet vacationers with the same unsanitary condition.

The vesting of Bulyga with the powers of the village head of Koktebel in the modern history of Crimea created a precedent for the implementation of judicial decisions of Ukraine on the territory of a constituent entity of the Russian Federation. In this case, both the Speaker of the State Council Vladimir Konstantinov and the current acting President are subject to criminal prosecution. the head of the republic Sergei Aksenov, in respect of whom Ukrainian courts issued decisions on detention.

Let us recall that on September 5, 2013, the Feodosia City Court sentenced Bulyga to 3 years in prison in a case of official negligence. Bulygi was sent straight from the courtroom to the Simferopol pre-trial detention center.

The mayor of Koktebel was charged on March 5, after the investigative department of the Crimean police headquarters established the mayor’s involvement in the illegal lease of municipal property.

On March 11, the Kiev District Court of Simferopol granted the investigation’s request and suspended Bulyga from office for 2 months while the investigation was conducted. Despite this, the village mayor continued to perform official duties until the Feodosia City Court terminated criminal proceedings against the mayor.

The Crimean prosecutor's office appealed the decision of the Feodosia court to the appellate instance, and the case was returned for a new trial.

In parallel, the Crimean Prosecutor's Office is conducting four more investigations against the mayor for exceeding official powers, leading to grave consequences regarding the disposal of coastal lands and their development.
